Terms of Use

Effective October 23, 2026

These Terms of Use ("Terms") govern access to and use of the MSP Configuration Tool web application at certs.tiertek.com (the "Service") and the ClientSupport desktop application ("ClientSupport"), provided by TierTek IT Solutions, LLC, an Indiana limited liability company ("TierTek", "we", "us"). Before using the Service, each user must accept these Terms, and accepting them, or accessing or using the Service, means you agree to them. If you use the Service on behalf of an organization, such as a managed service provider ("MSP"), you confirm that you have authority to bind that organization, and "you" includes that organization. If you do not agree, do not use the Service.

If your organization has a separate signed agreement with TierTek covering the Service, that agreement controls wherever it conflicts with these Terms. Our Privacy Notice explains how we handle information.

1. The Service

The Service lets MSPs configure, brand, and deploy ClientSupport to their clients' computers, and manage the related users, certificates, and installations. It is provided for business use only. We may change, add, or remove features at any time.

2. Accounts and security

  • Accounts are for named individuals and may not be shared.
  • You must keep your password and two-factor authentication device secure, and you are responsible for all activity under your account.
  • Tell us promptly at support@tiertek.com if you suspect unauthorized access.
  • MSP administrators are responsible for who they invite, the roles they assign, and removing access when it is no longer needed.

3. Your responsibilities as an MSP

You are solely responsible for:

  • your relationship with your clients and their end users, including the computers you deploy ClientSupport to, and having the right to install and run it on them;
  • giving your clients and end users any required notices, and obtaining any required consents, about ClientSupport and the information it collects;
  • your own compliance with laws and contracts that apply to you and your clients, including HIPAA and any business associate agreements you have with your clients;
  • the accuracy and lawfulness of everything you enter into the Service; and
  • your mail server and the messages ClientSupport sends through it on your behalf, including where they are delivered and how they are stored.

Do not enter protected health information ("PHI") or other sensitive personal information about patients or end users into the Service. The Service is not designed to store it. You should configure ClientSupport forms so that end users are not asked for PHI.

4. Commands and content you configure

The Service lets MSPs configure content that ClientSupport delivers to or runs on end-user computers. This includes tray-menu commands ("Execute a CMD"), links, forms, and branding. This content is yours. TierTek does not review, approve, test, or support it, and is not responsible for what it does. Any command you configure runs on every computer where your ClientSupport installation is deployed, as the signed-in user. You are solely responsible for its effects, including any damage, data loss, security incident, or disruption it causes. Do not configure anything that is malicious, unlawful, or that you are not authorized to run on those computers.

5. Acceptable use

You agree not to:

  • use the Service or ClientSupport in violation of any law or anyone else's rights;
  • distribute malware, or use the Service to gain unauthorized access to any computer, account, or network;
  • probe, scan, or test the Service's security, or bypass its access controls, authentication, licensing, or certificate checks, without our written permission;
  • interfere with or overload the Service;
  • copy, modify, reverse engineer, or decompile the Service or ClientSupport, except where the law expressly permits it despite this restriction; or
  • resell or provide the Service to anyone outside your organization and its clients, except as agreed with TierTek in writing.

6. ClientSupport software and certificates

While your account is active, TierTek grants you a limited, non-exclusive, non-transferable, revocable license to install ClientSupport on your clients' computers and use it to provide services to those clients. TierTek and its licensors keep all rights, title, and interest in the Service, ClientSupport, and related software, documentation, and certificates. Certificates issued by the Service are for use only with ClientSupport. We may revoke them as described in section 7, and ClientSupport installations may stop working when their certificate is revoked or expires.

7. Suspension and termination

We may suspend or terminate access to the Service, revoke accounts or certificates, or disable installations, with or without notice, if we reasonably believe it is necessary. Reasons include a violation of these Terms, non-payment under a separate agreement, a security risk, or a legal requirement. You may stop using the Service at any time. Sections 3, 4, and 8 through 12 survive termination.

8. Disclaimers

The Service and ClientSupport are provided "as is" and "as available". To the fullest extent permitted by law, TierTek disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. TierTek does not warrant that the Service or ClientSupport will be uninterrupted, error-free, or secure. It also does not warrant that messages sent through ClientSupport will be delivered, or that any data will be preserved. The Service is not a backup or archiving service.

9. Limitation of liability

To the fullest extent permitted by law, TierTek and its members, managers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Service, ClientSupport, or these Terms, even if advised of the possibility of such damages. TierTek's total liability for all claims arising out of or relating to the Service, ClientSupport, or these Terms will not exceed the greater of (a) the amounts you paid TierTek for the Service in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

10. Indemnification

You will defend, indemnify, and hold harmless TierTek and its members, managers, employees, and contractors from and against any claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • your use of the Service or ClientSupport;
  • your clients or their end users;
  • commands or other content you configure (section 4);
  • your mail server or messages sent through it; or
  • your violation of these Terms or any law.

11. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.

12. General

These Terms, together with the Privacy Notice and any separate signed agreement, are the entire agreement between you and TierTek about the Service. If any provision is found unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver of it. You may not assign these Terms without our consent, and we may assign them in connection with a merger, acquisition, or sale of assets. We may update these Terms. When we do, we will change the effective date above. If a change is material, we will provide notice through the Service or by email. Continued use after an update means you accept the updated Terms.
